ASAAN MOBİL UYGULAMA GİZLİLİK POLİTİKASI VE KULLANIM KOŞULLARI

  1. Asaan App. Gizlilik Politikası

Asaan Telekomünikasyon ("Asaan", "biz" veya "bize"), mobil yazılım uygulaması ("Asaan App") aracılığıyla İnternet Protokolü Üzerinden Ses (VoIP) telefon hizmetleri ve ilgili ürünler gibi iletişim hizmetleri sunmaktadır.

 

Veri gizliliği yasasına uygun olarak ve Bilgi Güvenliği Yönetim Sistemi (BGYS) ve Kişisel Veri Yönetim Sistemi (KVYS) kapsamında, bu Gizlilik Politikası ve Kullanım Şartları ("Politika"), bu mobil uygulamada ("Asaan Uygulaması") ve tarafımızca sahip olunan ve işletilen web sayfalarında hakkınızda toplanan kişisel bilgileri nasıl kullandığımız, koruduğumuz ve ifşa ettiğimiz hakkında önemli bilgiler içerir. web sitemizde ("www.assan.app") ve ticari müşteriler için müşteri portalı aracılığıyla sağlanan hizmetlerin yanı sıra.

  1. Veri toplama ve yardımcı program

Hizmetler hakkında bilgi aradığınızda, mobil uygulamayı indirdiğinizde, bir hesap oluşturduğunuzda, bilgi talep ettiğinizde veya bir e-postaya veya başka bir kişi listesine dahil edilmeyi istediğinizde, Asaan sizden bazı bilgiler toplar.   6. Data kept on your device, including but not limited to traffic data and weblogs, may also be accessed by Asaan for our own invoicing purposes and the resources that you access when using the Asaan App. This includes but is not limited to the following:
    • Asaan App operation and improvement
    • Research and analysis targeted at enhancing Asaan products, services, and technologies.
    • Ads that are more relevant to your choices and interests will be shown to you.
    • Communicating with you, including but not limited to mandatory service messages such as welcome letters, billing reminders, information on technical service difficulties, and mandatory Government notifications.
  7. Government and Regulatory obligations, including sim registration, may require Asaan to use your personal information.
  8. We may use your information for advertising purposes, by displaying targeted advertisements from both the Asaan Partners and related entities, as well as from other Asaan Partners and related companies.
  9. Provision of data accuracy

In relation to the information you have supplied, you hereby declare and warrant to Asaan the following:

  1. That each and every piece of information that you have supplied is genuine, correct, up-to-date, and comprehensive.
  2. Your submissions are suitable for publication, and you agree to indemnify Asaan in the event that a third party takes legal action against Asaan as a result of your submissions.
  3. Indemnify Asaan in the event that any third party takes action against Asaan in regard to the information and/or material you have submitted.
  4. That Asaan has the permission to publish any information or other material that you have given them.
  5. If you provide information or materials to Asaan, you guarantee that Asaan will not be held liable for any use of that information or materials, or any notions described therein, in Asaan products or services.
  6. Herewith, you hereby agree and accept that Asaan may share your personal information and data with third parties in order to perform specific obligations. Those parties will only be able to access the information they need to carry out their duties, but they must maintain the confidentiality of that information and may not use it for any other purpose than that.

 

 

  1. Privacy of Children

If you’re under the age of 13, don’t use Asaan websites or software clients. We don’t purposely or knowingly collect Personal Information from anybody under the age of 13 on our sites (or older in some jurisdictions). We want to make sure that no information on a kid is acquired without the consent of the child’s parents, thus we encourage parents to monitor their children’s online activity. 

 

We take seriously our responsibility to safeguard children’s privacy. Children under the age of 13 are not solicited or asked for personal information by us, nor do we send them requests for such information. This data will be removed from our systems if we discover it belongs to a kid under the age of 13.

  1. Third party and government agency disclosure of your information

You acknowledge and agree that Asaan has the right to share Your Information with any member of our group or connected organizations, including our subsidiaries, ultimate parent company, and subsidiaries.

The sale, acquisition, or transfer of our business and assets may necessitate the disclosure of your personal data, in which case we shall do so to the prospective buyer or seller of such assets because such information is one of the transferred assets.

Whenever Asaan is required to do so by a Court Order, Legal, Regulatory or Governmental obligation and request, Asaan may release your information. Any request made by government regulators or security agencies falls under this category.

Third-party vendors, such as the makers of various equipment or devices that can be purchased or leased from / by Asaan, may provide some products and services. Except for our Marketing Partners, agents, and dealers; third-party telecommunications carriers and Internet backbone providers; vendors, licensors, and suppliers, such as payment processors, software or hardware providers, our customer portal host, and others who perform similar functions on our behalf and require such information to provide, bill for, or maintain the products and services you have purchased, we will not share or sell your personal information with third parties.

To protect our legal rights or the rights of others, we may disclose your personal information when required or authorized by law, or when relevant to judicial or governmental investigations or proceedings; in connection with a sale, purchase, merger, restructuring, liquidation or dissolution involving Asaan; and when necessary to respond to an emergency, which includes protecting you from a potential threat.

Please note that, in line with the applicable regulations, Asaan may monitor or record your use of the Asaan Application for security and/or quality control purposes.

 

  1. Data safety and storage

In order to help prevent the loss of, abuse of, and modification of the personally identifiable information that we collect on our website, we make every effort to ensure that our servers and computer networks are protected against unauthorized access and use. When you apply for a Service, enroll in the Service, or pay for Services through our customer portal, we use sophisticated software to ensure the privacy of your information. 

This also applies when you pay for the Services. In addition, we protect the personally identifiable information that we have in our control with sufficient administrative, technical, and physical precautions. We have put in place a series of security processes to ensure that we are doing everything in our power to preserve the safety and integrity of our systems from any potential dangers or threats that may arise in the future. Even while we take reasonable precautions to preserve information security and demand the same from our vendors, we are unable to guarantee the safety of any personally identifiable information that you provide to us. 

We also encourage our customers to do their part in protecting their personal and sensitive information, which includes taking responsibility for maintaining the confidentiality of their account login information and any other passwords they may use.

We take all necessary technical and organizational measures so that your personal data is protected from loss, misuse, alteration, or disclosure by ensuring a level of security commensurate with the risks of processing and the nature of the personal data being protected, while also taking into consideration their sensitivity.

If you provide us with any personal information, it may be transferred to and kept on our servers, third-party servers, data centers, or the cloud. This information may be located both within the Territory and outside of the Territory. Personnel working for us or one of our suppliers who are based outside the Territory will also process the information you provide them with. 

Depending on your request, order, or reservation, one or more of these employees may also be tasked with processing your payment information or providing customer care. You consent to the transfer, storage, or processing of your personal data by submitting this form.

Every piece of information that you give to us is safely saved on our encrypted servers. You are responsible for maintaining the confidentiality of any passwords that We have provided to you for use inside the Asaan App or within the Asaan Products and Services. These passwords may have been provided to you by Us, or you may have chosen them yourself. Please do not divulge this password to anyone under any circumstances.

In spite of Asaan’s best efforts to protect the privacy of your personal information; however, the company is unable to guarantee the complete safety of the data you send to the Asaan app because the transmission takes place over the internet, which exposes the data to the possibility that it will be intercepted. As a result, you assume full responsibility for any risks associated with the transmission of your information over the internet.

Asaan takes every precaution to ensure that the confidentiality of your data and communications is maintained. However, you should be aware that there is a possibility that your communications could be observed by someone other than the intended receiver for reasons that are beyond Asaan’s control. This is something that you should prepare yourself for. 

Therefore, Asaan is not liable for the transmission and/or reception of content of any sort that violates intellectual property rights, as well as for any unauthorized access to or loss of information and data that is uncontrollable.

Asaan retains your personal data as long as necessary to comply with its legal and commercial responsibilities.

Your use of the Asaan App and/or content is subject to the terms and conditions of any web site linked to the Asaan App, as well as any Product or Service Terms and Conditions.

  1. Use of Cookies

Asaan, like many other websites, uses cookies to collect information about users’ browsing habits. When a user or customer uses a computer, smartphone, or other internet-enabled device (such as a “Terminal”), a cookie may be stored on that device.

Cookies are a very useful tool because they allow a website to recognize a User or a Customer, marking their passage from one page to another and bringing additional benefits such as increased ease of browsing, a secured connection, and adaptation of web page content according to the preferences and Terminal of the user.

However, the cookie file has a unique identifier that can be used to track the activity of a specific user. Under this Policy, if you don’t agree with this Policy, or if you’re not satisfied with the Asaan App and/or Services, or if you have any claims against Asaan, your only option is to stop using the App and/or Services.

Asaan assumes no responsibility for information and/or content developed or published by third parties that is included in the App and Services or that may be connected to the App, unless this is specifically mentioned.

Asaan therefore states that it will take adequate measures to ensure the maintenance and availability of the App and the Services, but disclaims any duty and/or liability for the consequences of any app and/or content flaws.

The App and/or Services available on the App are provided on a “as is” and “as available” basis and Asaan expressly disclaims all liability for any damages, including but not limited to special, indirect, punitive, or consequential damages, arising from or related to the performance or use of such App and/or Services, whether in an action of contract or negligence.

Asaan expressly disclaims any and all liability for any loss resulting from:

  1. delays, non-delivery, missing deliveries, or service outages; and any loss of any of your content.
  2. There may be some bugs in the app and the services and we are not responsible for them. We also are not responsible for any losses you may incur as a result of using or not using the app and the services at all times.
  3. This includes but is not limited to viruses, bugs, and/or any other disabling features that may interfere with the usage of the App and/or your device.
  4. interoperability issues with other websites, services, programs, and/or hardware and/devices.
  5. The App is not responsible for any delays or failures you may encounter when using the App to initiate, conduct, or complete any transmissions or transactions.

Indemnify and hold Asaan harmless from and against any claim brought by a third party resulting from your breach or non-observance of this Policy and/or the use of the App and the Services, or the provision of content to Asaan, as well as Asaan’s use of the content you provide.
